These are the terms you agree to when you buy a Montana Snow Report season pass. The core terms apply to every product Montana Property Reports, LLC sells; Schedule D describes this one. The disclaimer forms part of these terms.

Core terms

1. Who you are buying from

Montana Property Reports, LLC is a Montana limited liability company based in Livingston, Montana ("we", "us", "our"). These terms are an agreement between you and Montana Property Reports, LLC. We are independent. We are not affiliated with, endorsed by, or acting on behalf of the State of Montana, any of its agencies, or any federal agency whose public records these reports draw on.

2. What you are buying

You are buying the gathering, organization and analysis of public records for one property, delivered as a report. You are not buying the records themselves, which are public, and you are not buying a guarantee about the property. What each report covers, and what it cannot settle, is set out in its schedule below and on that site's disclaimer page, which forms part of these terms.

3. Delivery

Reports are generated and delivered by email, and where the site offers it, as a downloadable PDF and a private link. Delivery is normally immediate to within a few minutes. Each schedule states that product's delivery commitment. If we fail to deliver within the stated window, you are entitled to a full refund whether or not you ask for one.

4. Price, payment and subscriptions

Prices are shown on each site before purchase and are charged in US dollars through Stripe. We do not see or store your full card number.

Subscriptions, where offered, are billed monthly in advance and renew automatically each month until you cancel. The renewal price and date are shown in your account. You can cancel at any time; cancellation takes effect at the end of the current billing period, and partial months are not pro-rated. We will tell you before any price change applies to your renewal.

Prices may change. A change never affects a purchase already completed.

5. Refunds

If a report is not worth what you paid, tell us and we will refund it. You do not need to justify the request. Email the address on that site's contact page within 30 days of purchase.

This applies whether the report told you something you did not want to hear, whether it was thin because the public record is thin, or whether you simply did not find it useful. A report that shows poor water, high wildfire exposure or a hard building site has done its job, and we would rather refund you than argue about it.

Subscription months already used are not refunded, but you can cancel before the next renewal.

6. What these reports are not

No report we sell is:

• legal advice, or a title opinion, or title research
• engineering, geotechnical or hydrogeologic certification
• land surveying, or any determination of a boundary
• an appraisal or an opinion of value by a licensed appraiser
• a permit, an approval, or a determination by any government body
• a guarantee that a property can or cannot be built on, drilled on, insured, or financed

Mapped is not determined. Outside a mapped high-risk flood area is not the same as no flood risk. A mapped wetland is not a jurisdictional delineation. A road on a map is not legal access. A modeled wildfire figure is not an assessment of your house.

Decisions with money attached, buying land, drilling a well, extending credit, starting construction, should involve a licensed professional and the responsible county office. These reports are built to make that conversation better informed, not to replace it.

7. Accuracy and the limits of the source data

We do not create the underlying records and cannot warrant their accuracy or completeness. Government datasets carry their own scale limits and their own lag, and each site's sources page states them. Where the record is thin, our reports say so and lower their stated confidence. We do not fill gaps with invented text. If you believe a figure is wrong, tell us: we would rather correct it than defend it.

8. Acceptable use

You agree not to:

• scrape, bulk download, or systematically extract our reports or the database behind them
• resell or redistribute reports as your own product, or remove our attribution
• present our analysis as a certified professional opinion or as your own professional work
• use a report to misrepresent a property to a buyer, a lender or a regulator
• circumvent payment, share credentials, or reach paid analysis you have not bought

Sharing a report with the parties to a specific transaction, your client, their lender, their attorney, a contractor quoting the work, is expected and permitted.

9. Limitation of liability

To the maximum extent the law allows, our total liability arising out of a report or your use of these services is limited to the amount you paid us for it, and for subscriptions, to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, consequential or punitive damages, including lost profits, a failed transaction, a dry hole, drilling or construction costs, or a change in property value.

This is a cap, not an escape. It reflects what the product honestly is: we charge tens of dollars to organize public records, and we cannot underwrite a land purchase, a drilling program or a building project.

The services are provided "as is", without warranties of any kind, except as stated in section 10.

10. Rights we do not limit

Nothing in these terms limits or waives:

• any liability for fraud, willful injury, or a willful or negligent violation of law
• your rights under the Montana Unfair Trade Practices and Consumer Protection Act
• any other right that cannot be waived by agreement under Montana law

If any part of these terms is held unenforceable, the rest continues to apply.

11. Changes

We may change the services and these terms. A material change is reflected in the effective date above, and continuing to use the services after a change means you accept it. A report you have already bought stays available and renders as it did when you bought it, with its own data vintage stamp.

12. Governing law

These terms are governed by the laws of the State of Montana, without regard to its conflict of law rules.

Schedule D: Montana Snow Report

Products. Snow Pro season pass, $29, one time. Business season pass, $99, one time. Each pass covers one season, November 1 to April 30, and does not renew; a new season means a new pass.

What it covers. Alerts by text message and email, chosen by the buyer from the site's mountain passes, SNOTEL stations, basins and avalanche zones: a pass's winter travel impact reaching a chosen level, new snow at a station, forecast snow at a place, a basin crossing a percent-of-median line or reaching its peak or melt-out, an avalanche warning issued for a zone, and a morning brief. Snow Pro covers one phone number. Business covers up to ten phone numbers and adds a weekly snowpack note.

Delivery. Alerts are sent within minutes of the underlying data changing, inside the hours the buyer chooses, through third-party carriers and email providers. Alert set-up opens on the site before the season begins, and the buyer is told by email at the address given at purchase on the day it does.

What it cannot settle. Every alert repeats a figure published by the National Weather Service, the Natural Resources Conservation Service, the Montana Department of Transportation, the U.S. Geological Survey or an avalanche center. An alert is not an official warning, weather forecast, road report or avalanche forecast, and a missed, delayed or garbled message is not a basis for a safety decision. Message delivery depends on carriers and networks we do not control and is not guaranteed. Rely on the National Weather Service, the issuing avalanche center and Montana 511 for safety decisions.

Free tier. The site, one email alert and the morning brief are free and need no account.
